NRI MAN CELL DELHI : FIR dont end automatically on settlement!! What to do? & What NOT to do?


A fresh Delhi High Court order dated 7 September 2026 in Vikas Sharma & Ors. v. State Govt. of NCT of Delhi & Anr., CRL.M.C. 6552/2026, dealt with a matrimonial FIR registered at P.S. Kanjhawala, Delhi.

The FIR was No. 524/2018 and included allegations under Sections 498A/406/506/354/377/34 IPC.

The parties later entered into a Settlement Deed dated 20.12.2025.

An amount of ₹12 lakh was subsequently handed over to the complainant through a demand draft dated 17.07.2026.

The complainant appeared before the Court and stated that she did not want further action against the petitioners.

The Delhi High Court then considered whether the criminal proceedings could be quashed on the basis of the settlement.

But the interesting part is not simply that the FIR was eventually quashed.

The Court discussed an important principle:

The timing of a compromise can matter.

The Court referred to the principle that in appropriate matrimonial disputes, quashing may be considered at the investigation or early-trial stage, while the position can become different once evidence is substantially complete or a conviction has already been recorded.

So for someone facing CAW CELL DELHI, the dangerous assumption is:

“पहले FIR चलने दो, बाद में settlement कर लेंगे.”

That may not always be the safest way to look at the situation.

A matrimonial FIR can move through investigation, charge-sheet, cognizance, charge and trial.

Meanwhile, the family may be dealing with CAW Cell Nanakpura, CAW Cell Seema Puri, Crime (Women) Cell Delhi, DV proceedings or other connected matrimonial litigation.

The point is NOT that every FIR should be settled.

The point is:

Understand the procedural stage before deciding what your next step should be.

And if settlement is genuinely being considered, don't treat a private understanding or WhatsApp conversation as equivalent to legal closure of criminal proceedings.

Settlement और FIR quashing — ये दो अलग procedural steps हैं.

MenCell.Org Delhi: PROPERTY DISPUTE में ₹9 Crore की deal, possession मिल गया, FIR भी हुई — Court ने कहा अभी investigation होगी

अगर आपने PROPERTY खरीदने के लिए पैसा दिया, possession ले लिया और फिर title पर सवाल उठ गया, तो यह मत मानिए कि मामला सिर्फ CIVIL PROPERTY DISPUTE है और FIR अपने-आप खत्म हो जाएगी.

Delhi High Court का 17 September 2026 का judgment इस बात को बहुत सीधे तरीके से दिखाता है.

Sainik Farms, Delhi की property के लिए लगभग ₹9 CRORE का transaction proposed था.

Buyer side ने ₹11,000 दिए, फिर ₹25 lakh के दो cheques और 20 March 2023 को ₹20 lakh RTGS से transfer किए.

अगले दिन possession भी मिल गया.

लेकिन पूरा payment नहीं हुआ.

फिर title dispute सामने आया.

Competing Wills और ownership claims भी सामने थे.

इसके बाद FIR हुई — Sections 420, 448 read with 34 IPC.

Petitioners ने Delhi High Court में कहा कि मामला असल में CIVIL PROPERTY DISPUTE है, इसलिए FIR quash होनी चाहिए.

Court ने ऐसा नहीं किया.

Court ने कहा कि allegations को देखकर यह जांचना जरूरी है कि शुरुआत से ही कोई dishonest representation था या नहीं.

और एक बहुत important point आया.

Property में entry शुरू में consensual हो सकती है.

लेकिन अगर बाद में payment, possession या vacating को लेकर अलग circumstances सामने आते हैं, तो Court investigation stage पर यह मानकर नहीं चल सकती कि कोई criminal offence बन ही नहीं सकता.

यही जगह है जहाँ PROPERTY FRAUD और ordinary contract dispute के बीच फर्क पैदा हो सकता है.

Court ने यह भी कहा कि disputed TITLE, competing Wills और ownership questions को Section 482 proceedings में final तरीके से decide नहीं किया जा सकता.

मतलब साफ है:

आपके पास SALE DEED नहीं है, Agreement to Sell है, कुछ payment हुआ है, possession मिल चुका है और सामने वाले के TITLE पर dispute है — तो documents की पूरी chain बहुत important हो जाती है.

PROPERTY DISPUTE में सिर्फ “मेरे पास agreement है” बोलना पर्याप्त नहीं.

और सामने वाला सिर्फ “यह civil matter है” बोलकर हर FIR को रोक नहीं सकता, अगर allegations prima facie cognizable offence disclose करते हों.

इस case में Court ने FIR quash नहीं की.

लेकिन Court ने यह भी साफ किया कि उसके observations final title decision या guilt का finding नहीं हैं. Investigation और competent proceedings अपना रास्ता लेंगी.
